1. Acceptance of Terms

By downloading, installing, or using the Ember Quotes mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting updated Terms in the App. Your continued use after changes constitutes acceptance of the modified Terms.

2. Description of Service

Ember Quotes is a motivational quotes application that allows you to:

• Receive a fresh inspirational quote each day
• Save favorite quotes to a personal collection
• Set daily notification reminders
• Share quotes with friends
• Customize the app with visual themes
• View quotes via a home screen widget

3. Subscriptions and Payments

3.1 Free Tier

The App offers a free trial period with access to all features. After the trial expires, a subscription is required to continue receiving daily quotes.

3.2 Premium Subscription

Premium subscriptions unlock continued access to daily quotes, notifications, and all app features.

3.3 Billing

• Subscriptions are billed through the Apple App Store
• Payment is charged to your App Store account
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Prices are subject to change with notice

3.4 Cancellation

You may cancel your subscription at any time through your device's subscription settings:

• iOS: Settings > [Your Name] > Subscriptions

Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.

3.5 Lifetime Access

A one-time lifetime purchase option may be available, granting permanent access to all premium features without recurring charges.

3.6 Refunds

Refund requests are handled by Apple according to their refund policy. We do not process refunds directly.

4. Use of the App

You agree to use Ember Quotes only for personal, non-commercial purposes. You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to the App or its systems
• Reverse engineer, decompile, or disassemble the App
• Redistribute, modify, or create derivative works from the App or its content
• Use automated systems to access the App
• Resell or redistribute the App or its features

5. Intellectual Property

5.1 Our Intellectual Property

The App, including its design, features, code, and curated content, is owned by Silent Planet and protected by intellectual property laws. You may not copy, modify, or distribute the App without permission.

5.2 Quote Attribution

Quotes displayed in the App are attributed to their original authors where known. Public domain quotes are used freely. All other quotes are used with appropriate licensing or attribution.

5.3 Feedback

If you provide feedback or suggestions about the App, you grant us the right to use such feedback without compensation or attribution.

6. Disclaimers

6.1 "As Is" Provision

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

6.2 Service Availability

We do not guarantee that the App will be available at all times or operate without interruption or errors. We may modify, suspend, or discontinue the App at any time without notice.

6.3 Quote Accuracy

While we strive for accuracy in quote attribution and content, we do not guarantee the accuracy or completeness of all quotes and attributions.

7. Limitation of Liability

To the maximum extent permitted by law:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• We shall not be liable for any loss of data, profits, or goodwill
• Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim

Some jurisdictions do not allow limitation of liability for certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

8. Indemnification

You agree to indemnify, defend, and hold harmless Silent Planet and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights

9. Termination

9.1 Termination by You

You may stop using the App and delete it from your device at any time.

9.2 Termination by Us

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. Reasons for termination may include:

• Violation of these Terms
• Fraudulent or illegal activity
• Discontinuation of the service

9.3 Effect of Termination

Upon termination:

• Your right to use the App ceases immediately
• Provisions that by their nature should survive (Disclaimers, Limitation of Liability, Indemnification) will remain in effect

10. Dispute Resolution

10.1 Informal Resolution

Before filing any legal claim, you agree to contact us at support@silentplanet.app and attempt to resolve the dispute informally for at least 30 days.

10.2 Governing Law

These Terms are governed by the laws of your jurisdiction, without regard to conflict of law principles.

10.3 Class Action Waiver

You agree to resolve disputes with us on an individual basis. You waive any right to participate in a class action lawsuit or class-wide arbitration.

11. General Provisions

11.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.

11.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

11.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

11.4 Assignment

You may not assign your rights under these Terms. We may assign our rights without restriction.

11.5 Force Majeure

We are not liable for any failure to perform due to circumstances beyond our reasonable control.
